This refer to the Resolution No. 759-26, Series of 2026, of the Sangguniang Panlalawigan (SP) of Surigao del Sur, re: “Asking Clarification from the Department of Environment and Natural Resources (DENR) – Caraga, Environment Management Bureau (EMB), Protected Area Management Board (PAMB) and the Mines and Geosciences Bureau (MGB) as to the Propriety of Including of Excluding Watershed Areas for Mining Operation, as Appealed by Brightgreen Resources Corporation (BRC) for Purposes of a Possible Favorable Endorsement from the 21st Sangguniang Panlalawigan of Surigao del Sur”, which was adopted and approved on 3 February 2026 and furnished this Office on 10 February 2026. The latter informed the Body that the request of BRC for amendment of the SP Resolution No. 1034-23 was borne out from their recommendation per Letter dated 28 July 2025 considering it does not constitute the required project approval/recommendation due to various conditions, particularly, “The mining operations of BRC will be limited to the areas that are not covered by Presidential Proclamation No. 1747 and other prevalent laws defining watersheds as well as the pertinent provisions of the terms and conditions of the terms and conditions of MPSA No. 015-93-XI”, for the Body’s information and appropriate action. 26-05694
