15. Letter from Mr. Elizer S. Salilig, MFT, National Director, Bureau of Fisheries and Aquatic Resources, Visayas Ave., Quezon City, dated August 26, 2026, addressed to Mr. Edgar G. Perez II, J.D., Secretary to the Sangguniang Panlalawigan, this province, acknowledging receipt of Resolution No. 1232-26, Series of 2026, adopted by the Sangguniang Panlalawigan of Surigao del Sur, requesting the Office not to realign or reprogram funds appropriated for hatchery projects in the Province of Surigao del Sur, particularly those in Lingig, Hinatuan, Barobo and Bislig City. He informed the Body that the establishment of the Multi-species Marine Hatcheries in the aforementioned areas is mandated under Republic Act Nos. 10787, 10944, 10941, and 10937, respectively. Under these laws, DA-BFAR is responsible for the establishment and initial supervision of the hatcheries, including the training and phasing-in of personnel of the concerned Local Government Units (LGUs) prior to the transfer of management. Further, Section 3 of each of the above laws specifically provides that the Secretary of Agriculture shall include in the programs of the Department of Agriculture the establishment of the hatchery, the funding shall be incorporated in the annual General Appropriations Act. The same provision requires the concerned LGU to allocate an amount deemed appropriate for the operationalization of the hatchery from any available local revenue. In pursuance of these provisions and the applicable Implementing Rules and Regulations, the funds appropriated for DA-BFAR shall be utilized to support the establishment and initial operation of the hatcheries during the prescribed two-year interim period including activities necessary to make facilities operational and to train and phase-in LGU personnel in preparation for the transfer of operation and management. Thereafter, the concerned LGUs are expected to assume responsibility for the operation and management of the hatcheries and to provide necessary funding from their available local revenues, as expressly provided under Section 3 of their respective enabling laws. BFAR shall continue to provide technical assistance and monitoring consistent with the laws and implementing rules. In this regard, the Office recognizes the need to retain and use, subject to the availability of the appropriations and applicable budgeting, accounting, procurement and auditing rules under the law, the funds still needed to complete the establishment and prescribed two-year interim operation of the concerned hatcheries. For completed facilities that have not yet started interim operation, priority shall be given to operationalization, training and phasing-in of LGU personnel, and the establishment of a definite schedule for eventual turnover to the concerned LGUs. Therefore, the concerned LGUs are likewise encouraged to undertake the necessary preparations for the eventual transfer particularly the provision of qualified personnel and the allocation of appropriate funds from available local revenues for the operation and management of the hatcheries, in accordance with Section 3 of their respective enabling laws. The Office will continue to coordinate with BFAR RFO CARAGA and the concerned LGUS to facilitate the operationalization and eventual transfer of the hatcheries, for the Body’s information and appropriate action. 26-06257
