3. Letter from Hon. Alexander T. Pimentel, Provincial Governor, this Province, dated October 23, 2024, addressed to Hon. Josie M. Bonifacio, M.D., Mayor, Municipality of Cortes, Surigao del Sur, copy furnished this Body, in reference to the letter dated October 22, 2024 of the Honorable Mayor, informing their Office that the law which controlling relative to the Administrative Cases Decision dated October 15, 2024 rendered by the Sangguniang Panlalawigan is Provincial Ordinance No. 17-2011, thereby making the Decision final and executory only after lapse of 30 days from receipt thereof. While it may be true that Section 32 of Provincial Ordinance No. 17-2011 provides that “The decision of the Sangguniang Panlalawigan of the Province of Surigao del Sur shall become final and executory after the lapse of thirty (30) days from receipt of a copy thereof, unless a motion of reconsideration is filed within the period”. Relative to this matter, the latter reminded the Honorable Mayor that the said provision only reiterated in Section 67 of the Local Government Code(LGC) of the Philippines that the aggrieved party has 30 days from receipt of the decision within which to file an Appeal. He also highlighted that the phrase “final and executory” in Section 67 and 68 of the LGC simply means that the administrative appeals will not prevent the enforcement of a decision. The decision is immediately executory but the respondent may nevertheless appeal the adverse decision to the Office of the President. He further informed the addressee that in the DILG Opinion No. 27, Series of 2017 also provides that the Decision of the higher Sanggunian shall become final albeit executory after the reglementary period of appeal has been executed, that is thirty (30) days from the receipt of the aggrieved parties of the Decision. Hence before the period is exhausted, the Decision of the lower Sanggunian is still executory. In view of the foregoing, the Decision dated October 15, 2024 rendered by the Sangguniang Panlalawigan of the Province of Surigao del Sur is immediately executory and as Governor it is his ministerial duty to implement the same, for the Body’s information.
