10. Resolution No. 109-2024 dated April 15, 2024 of the Municipality of Cantilan, this Province entitled “A Resolution to Override the Vetoed Ordinance No.2-2024”.
11. Letter from Hon. Philip A. Pichay, CPA, Municipal Mayor, Municipality of Cantilan, this Province dated May 2, 2024, addressed to Hon. Manuel O. Alameda, Sr., Vice Governor thru Sangguniang Panlalawigan Members, Office of the Sangguninag Panlalawigan, all of this Province, informing the Body the recent developments regarding Sangguniang Bayan Ordinance No. 2, Series of 2024 entitled “An Ordinance to Revoke the Remaining Amount of Twenty-Seven Million Pesos (P27,000,000.00) Out of the Fifty Five Million Pesos (P55,000,000.00) Ceiling Loanable Amount of the Local Government of Cantilan”, passed by the Sangguniang Bayan of Cantilan, which was vetoed by his Office, the Municipal Mayor dated March 20, 2024. According to him, upon careful consideration, he invoked his authority to veto the aforementioned Ordinance for it was prudent to question the rationale behind the proposed revocation of an Ordinance or Agreement already fulfilled its intended function. He elaborated that the initial allocation of P28,000,000.00 appears inadequate, emphasizing the criticality of the remaining P27,000,000.00 to fully realize the initiative’s objectives, including the procurement of requisite equipment or machinery and the jurisdiction for revoking the remaining funds due to the supplier’s contractual non-performance is deemed frivolous and such revocation would fundamentally deprive the residents of Cantilan of anticipated improvements infrastructure services. According to him, on April 15, 2024, the Sangguniang Bayan passed a Resolution No. 109-2024 entitled “A Resolution to Override the Vetoed Ordinance No. 2 - 2024”. However, it comes to his attention that this procedure does not align within the provisions outlined in Section 15 in the Local Government Code (LGC). As per the (LGC), overriding a veto requires the affirmative vote of two-thirds (2/3) of all the Members of the Sangguniang Bayan. Anent this, the former requested the Body to review the procedure followed by the Sangguniang Bayan and ensure that it complies with the legal requirements set forth in the Local Government Code, for the Body’s information and appropriate action.

3. Letter from Mr. Roderick P. Minardo, Secretary to the Sanggunian, Office of the Sangguniang Bayan, Municipality of Lanuza, this Province dated April 22, 2024, addressed to Hon. Valerio T. Montesclaros, Jr., Chairman, Committee on Agriculture/Fisheries, Tanggapan ng Sangguniang Panlalawigan, this Province thru Mr. Edgar G. Perez II, J.D., Secretary to the Sangguniang Panlalawigan, this Province, in response to the letter of the Body dated April 8, 2024, which was received by their end last April 11, 2024. The latter furnished this Body the legal opinion of the DILG Opinion No. 19, S. 2018 dated April 19, 2018, specifying therein the Ordinances necessitating a public hearing for review of the Body. Further, he emphasized that they acknowledge the validity of their Ordinances or Resolutions which hinges solely on adhering to the powers vested in their Sanggunian, as underscored in the Supreme Court Ruling Moday v. CA, 268 SCRA 586, February 1997. The criteria for validating their Ordinances are delineated in the case of Magtajas vs. Pryce G.R. No. 111098, July 20, 1994, wherein the Supreme Court affirmed that: (a) an Ordinance must not contradict with the existing laws enacted by Congress; (b) an Ordinance cannot permit what is expressly prohibited by law; (c) an Ordinance cannot prohibit what is expressly allowed by law but can regulate it; (d) an Ordinance must not prohibit but may regulate trade; (e) an Ordinance must be fair and not oppressive, avoiding partiality or discrimination; and (f) an Ordinance must be reasonable, general in application, and consistent with public policy. Therefore, any additional requirements beyond the aforementioned criteria are deemed unnecessary in the process of assessing the validity of their Ordinances, for the Body’s information.
