19. Ordinance No. 2023-13 dated July 18, 2023 of the City of Bislig, this Province entitled “An Ordinance Establishing a Coastal Greenbelt Zone and Adopting a Local Coastal Greenbelt Management Action Plan in the City of Bislig, Providing Funds Therefor and for Other Purposes”.

20. Transmittal letter from the Office of the Sangguniang Bayan of the Municipality of Madrid, this Province, dated August 2, 2023 addressed to Hon. Manuel O. Alameda, Sr., Vice Governor, Office of the Provincial Council, this Province, forwarding a response letter dated July 18, 2023 from Hon. Philip Y. Urquia, Vice Mayor and the Honorable Members of the Municipal Council, Municipality of Madrid, all of this Province, with Subject: Opposition to Sangguniang Panlalawigan of Surigao del Sur’s Resolution No. 938-23, series of 2023, declaring Ordinance No. 03-2023 of the Municipality of Madrid invalid. The latter summarized some points why the Sangguniang Bayan of the Municipality of Madrid disagreed with the Sangguniang Panlalawigan of Surigao del Sur’s Resolution No. 938-23, series of 2023, declaring Ordinance No. 03-2023 of the aforementioned municipality invalid, to wit:
1. The said Ordinance is not a Tax Ordinance but a Regulatory Ordinance. Thus, Section 516 of the Local Government Code (LGC) which defines the limits on imposable penalties for Tax Ordinance does not apply to it;
2. The administrative fees imposed under Ordinance No. 03-2023 are in the nature of regulatory fees imposable by a municipality under Section 147 of the LGC. Section 147 requires only that such regulatory fees be commensurate to the cost of regulation. Furthermore, pertinent jurisprudence indicates that so long as such fees are reasonable, the Ordinance under which these regulatory fees are imposed should be presumed to be valid;
3. The authority of the Sangguniang Panlalawigan to review Ordinances approved by the sanggunians of component cities and municipalities is limited only to the determination of whether such Ordinances were enacted within the powers and functions of the Sanggunians concerned as defined under the LGC. This power to review does not extend to the determination of the reasonableness of the fees imposed under the Ordinance. Such matter is to be resolved by the proper Courts through judicial review. The Sangguniang Panlalawigan of Surigao del Sur, therefore, exceeded its authority when it declared as invalid Ordinance No. 03-2023 solely for the reason that the administrative fees imposed therein are excessive;
4. There is no prohibition as to the use of the Dollar currency as to denomination of penalties and fees imposable under an Ordinance. Moreover, the Municipality of Madrid is not the first LGU in Surigao del Sur to enact an Ordinance using Dollar as the currency for the impossible fees or penalties. Thus, the use of Dollar currency cannot be used as a supporting ground for the declaration of invalidity of an Ordinance; and
5. The exercise of the authority of the Sangguniang Panlalawigan to review Ordinances approved by the sanggunians of component cities and municipalities should also comply with the thirty (30) day prescriptive period provided for under Section 56 of the LGC. Considering that the Sangguniang Panlalawigan of Surigao del Sur resolve to declare Ordinance No. 03-2023 invalid beyond prescribed period of review, Ordinance No. 03-2023 should be presumed consistent with law and therefore valid.
The latter hoped that the points and arguments presented in this letter are given due consideration and a thorough examination of these factors will lead to a fair and just resolution regarding the validity of the said Ordinance, for the Body’s information, reference and appropriate action.

Ordinance No. 2023-14 dated July 18, 2023 of the City of Bislig, this Province entitled “An Ordinance Establishing the Annual Commemoration of Indigenous Peoples (IPs) Month for the Promotion of Indigenous Peoples’ Dignity Rooted in History and Cultural Heritage, Every Month of October in Line with the National Celebration of Indigenous Peoples’ Month in the City of Bislig and Appropriating Funds Therefor”.
