5. Ordinance No. 06 dated April 15, 2024 of the Municipality of Bayabas, this Province entitled “An Ordinance Establishing the 70 – 30% Scheme on Claims of Total Leave Benefit (TLB) of Officials and Employees in the Municipal Government of Bayabas, Surigao del Sur”.

6. Letter from Mr. Roderick P. Minardo, Secretary to the Sanggunian, Office of the Sangguniang Bayan, Municipality of Lanuza, this Province dated May 7, 2024 addressed to the Members of the Sangguniang Panlalawigan, Tanggapan ng Sangguniang Panlalawigan, this Province, acknowledging receipt of the Sangguniang Panlalawigan Resolution No. 1900-24 concerning Ordinance No. 1, Series of 2024, which was submitted by their Municipality last February 26, 2024. The latter quoted in his letter Section 56, paragraph (d) of RA 7160, stating among others, that if no action is taken by the Sangguniang Panlalawigan within thirty (30) days after submission of such Ordinance or Resolution, it shall be presumed consistent with the law and therefore valid. Hence, they believed that the 30-day period for the Sangguniang Panlalawigan to review Ordinances or Resolutions approved by the Sangguniang Bayan is absolute and cannot be interrupted by any intervening actions, such as referrals to Committee, meetings, hearing, public consultations, or any other circumstances. Further, the phrase “take action” on the part of the Sanggunian within the prescribed period fixed by law should be construed as either approval or disapproval of the Ordinance as stated in DILG Legal Opinion No. LO019S2009. With the given legal frameworks, they asserted that any further discussion or action by the Sangguniang Panlalawigan in their Ordinance is immaterial, moot and academic, and would no longer affect the validity of the Ordinance, for the Body’s information and appropriate action.

7. Ordinance No. 07 dated April 22, 2024 of the Municipality of Bayabas, this Province entitled “An Ordinance Adopting the Legal Procedures in the Conduct of Administrative Investigations Against Elective Barangay Officials of Bayabas, Surigao del Sur”.

10. Ordinance No. 17 dated March 04, 2024 of the Municipality of San Miguel, this Province entitled “An Ordinance Creating the Organizational Structure of the Office of the Secretary to the Sangguniang Bayan”.
11. Ordinance No. 26 dated April 08, 2024 of the Municipality of San Miguel, this Province entitled “An Ordinance Amending the Approved Ordinance No. 30 – 2020, Entitled: An Ordinance Creating Three (3) Position Titles for the Office of the Municipal Assessor, Namely; 1) Computer Operator I, SG – 7; 2) Tax Mapper III, SG – 18; and 3) Assessment Clerk I, SG – 4 and Appropriating Funds Therefor; by Splitting the Position Title of Computer Operator I, SG – 7; Into Two (2) Position Titles, Namely: Administrative Aide IV (Data Entry Machine Operator I), SG – 6 and Administrative Aide II (Messenger), SG – 2, of Same Office”.
12. Letter from Hon. Manuel O. Alameda, Sr., Vice Governor, Office of the Provincial Vice Governor, this Province dated April 26, 2024 addressed to the Honorable Members of the Sangguniang Panlalawigan thru Hon. Antonio C. Azarcon, Chairman, Committee on Good Government, Public Ethics and Accountability, all of this Province, specifying therein Item No. 9.1.4.2 of the Department of Budget and Management’s (DBM) Manual on Position Classification and Compensation being consistent to the Provision of RA 7160, which provides that “Every LGU shall design and implement its own organizational structure and staffing pattern taking into consideration its service requirements and financial capability but subject to the minimum standards and guidelines prescribed by the Civil Service Commission (CSC)”. Anent this and in view of the Scrap and Build Policy, the former requested the Body to pass an Ordinances abolishing the administrative position title of Chauffer II, Item No. 7, SG-6/1 and create the administrative position title of Administrative Assistant IV (Bookbinder IV), SG-10/1, all in the Vice Governor’s Office (VGO), this Province, for the Body’s information and appropriate action.

Ordinance No. 25 dated April 08, 2024 of the Municipality of San Miguel, this Province entitled “An Ordinance Amending the Approved Municipal Ordinance No. 09-2023, Entitled: An Ordinance Requiring All the Farmers Under the NIA Irrigation System in this Municipality to Follow the Implementation of the CY 2022 – 2023 Cropping Calendar and Planting Pattern, and to Adopt the Policies and Regulations on Irrigation Facilities and Providing Penalties for Any Violation Thereof, by Adding New Provisions for Exemption Clause and Access to Irrigation Water Under Section 7 and Section 8 Thereof, Respectively”.

Ordinance No. 10-24 dated April 23, 2024 of the Municipality of Cagwait, this Province entitled “An Ordinance Revising and Integrating Additional Provisions of Ordinance No. 15-15 and Institutionalizing Organic Agriculture in the Municipality of Cagwait, Surigao del Sur Providing Funds Thereof and Other Purposes”.

The latter informed the Body that the use of electronic device system was already incorporated in the City Ordinance No. 009, Series of 2017, a Comprehensive Anti-Smoking Ordinance, for the Body’s information.

Raymundo, Provincial Administrator, all of this Province, for and in behalf of the Provincial Governor, furnishing the Body a copy of the letter from Ms. Merne T. Peñaranda, Director IV, Regional Director, Commission on Audit (COA), Region XIII, dated April 16, 2024, regarding the scheduled trainings and seminars to be hosted by COA as part of the Commission’s ongoing commitment to empower government officers and employees, for the Body’s information.

Alexander T. Pimentel, Provincial Governor to Japan while on Personal Leave and Designation Letter for the addressee as Acting Vice Governor of Surigao del Sur, for the Body’s information.
5. Letter from Former Vice Governor Librado C. Navarro, this Province dated May 9, 2024 addressed to Alexander T. Pimentel, Provincial Governor Office of the Governor, this Province, copy furnished this Body pertaining to the latter's response to the letter of the Honorable Provincial Governor dated April 4, 2024 which was received by Mr. Danilo Gabica dated April 29, 2024 at Ericson Subdivision, Poblacion, Bislig City, this Province, with Subject: “Demand to Vacate”, and giving the former fifteen (15) days to vacate in the property owned by the Provincial Government of Surigao del Sur with Lot No. 28-31/Lot No. 1 to 4 [as per Resolution No. 557-17], Block No. 3, Phase No.1, Provincial Housing Subdivision, Mancarogo, Bislig City, Surigao del Sur. With Prayer and in memory to his wife, Mrs. Carmencita “Tita” P. Navarro, who was murdered last September 15, 2018, who was the one who initiated the Application of Ownership of the two (2) lots and constructed the house, the latter requested the Honorable Governor that the two (2) lots be awarded to his only son, Mr. Clyde P. Navarro, only heir of the property and assured to religiously pay in installment basis to whatever be the final costing of the two (2) lots of the province, for the Body’s information.
